
Attorney General Appeals High Court Ruling
Attorney general Kalekeni Kaphale has appealed to Supreme Court of appeal against the dismissal by High court on his application to end demonstrations being organized by Human Rights Defenders Coalition HRDC.
Kaphale says is not satisfied with the ruling which was delivered by judge justice Andrew Nyirenda in the morning of Tuesday 6th August, 2019.
Nyirenda made the judgment after hearing arguments from the attorney general and HRDC lawyers at High Court in Lilongwe on Monday 5th August.
In his appeal Kaphale says the learned judge erred in law and fact hence asking for reversal of the ruling.
“The demonstrations are unlawful because are violent and have led to property damage and injuries to innocent people,” Kaphale argues
He adds that the demonstrations breach the rule and the injunction being sought does not pre-empt remedies in the main action.
