Court throws out SA lawyers application to represent MEC

Chief justice Andrew Nyirenda has thrown out the application for admission of two South African (SA) lawyers Dumisa Tsebeza and Elizabeth Mere to represent Malawi Electoral Commission MEC in presidential elections appeal case.

The two South African lawyers did not arrive in the country due to public health concern.

As a result they presented themselves to Malawian embassy in South Africa where they wanted to participate in the case through video teleconferencing.

According to Nyirenda “it is against the law for lawyers to represent MEC when they are in another country.”

This means MEC lawyer Tamanda Chokotho will represent the electoral body when the appeal case begins on April 15.

MEC appealed to supreme court after constitutional court nullified presidential elections on 3 February 2020.

MEC had declared President professor Peter Mutharika winner of 2019 tripartite elections.

However two opposition political parties UTM and MCP challenged the results and have now formed a coalition to win in 50 plus 1 electoral law.
