Judge dismisses ACB application

Justice Kenyatta Nyirenda has dismissed an Application by Anti-Corruption Bureau (ACB) that was seeking stay of a ruling he made on recusal.

Nyirenda refused to recuse himself from presiding over a judicial review case involving Former Inspector General of Police George Kainja who is challenging his arrest in relation to Zunneth Sattar Corruption case.

This prompted the ACB to apply for a stay of the ruling so that they can appeal.

But delivering his ruling on the Application, Justice Nyirenda has thrown out the application describing it as incompetent and an application that was not properly brought before the court.

This now means hearing on the judicial review will proceed, according to Gift Nankhuni, Lawyer representing Kainja.

The matter has since been adjourned to 15 November 2022.
