Constitutional Court Rejects Mutharika Lawyer on New Documents

Constitutional court has rejected documents which lawyers of the 1st petitioner who is President Professor Peter Mutharika wanted to use in cross examining MCP’s second witness Richard Chapweteka.

The court denied the documents after lawyers of Mutharika and MCP counter argued for over an hour on the matter.

However, lawyer of Mutharika Frank Mbeta said was unable to do last part of the cross examination because of the absence of the documents.

Mbeta then said “I will apply for them because they are very significant in the case since Chapweteka is the right person as he oversaw the printing of ballot papers in Dubai,”

Earlier lawyer of MCP Modecai Msisya rejected using the documents because they were not notified of them.

Thereafter, Mbeta cross examined Chapweteka on the booklets and tally sheets.

Then Chapweteka’s lawyer Msisya started re-examining him but Mbeta rejected the first question saying it was a leading one.

However, Msisya said “it was the question which he asked Chapweteka during his cross examination.”

The court asked Chapweteka to provide actual information he saw on the documents in Dubai
