Supreme Court hears Mutharika, MEC lawyers in appeal case

Supreme Court of appeal has heard arguments of lawyers of President Mutharika and Malawi Electoral Commission on elections case appeal.

The hearing takes place two days after the court threw out the application that South African lawyers should represent the commission.

Lawyer of Mutharika Samuel Tembenu presented 16 arguments saying the constitutional court erred in adopting the dictionary meaning of majority.

“The decision by the lower court in defining majority as 50 plus one creates confusion,” Tembenu says

On tippexed tally sheets he said it was wrong to nullify the election on the basis of alterations saying nobody proved in court that the use of tippex was done to give any party an unfair advantage.

Then lawyer Tamanda Chokotho presented arguments of Malawi Electoral commission did not specify the number of their arguments.

Meanwhile the court is expected to hear from lawyers of UTM and MCP in the afternoon

The constitutional court nullified the presidential elections in favour of the opposition political parties.
